Terms of Service

Effective 2026-10-15 · Privacy Policy

1. About WhatSmall and these Terms

WhatSmall (the “Service”) is operated by Smallution Limited (“we”, “us”), . The Service lets you link your own WhatsApp account as a companion device and keep a private, searchable archive of your conversations that you can export or delete at any time.

By creating an account you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Unofficial service — risk of restriction or ban

WhatSmall is not affiliated with, endorsed by, sponsored by or connected to WhatsApp LLC, Meta Platforms, Inc. or any of their affiliates. “WhatsApp” is a trademark of its owner and is used only to describe compatibility.

The Service connects to your WhatsApp account using unofficial software that is not approved by WhatsApp. WhatsApp's own terms may prohibit unofficial clients. WhatsApp may at any time and without notice restrict, suspend or permanently ban an account that uses such software, or change its systems so that the Service stops working. We cannot prevent, predict or reverse any such action.

WhatSmall only reads data and never sends messages, but this does not remove the risk. You use the Service entirely at your own risk. Do not link a number you cannot afford to lose. We are not liable for loss of, or restrictions on, your WhatsApp account, or for any resulting loss of contacts, messages, business or income.

3. Eligibility and your account

  • You must be at least 18 years old and able to enter a binding contract.
  • You must give accurate information, verify your email address, and keep your password confidential. You are responsible for activity under your account.
  • Tell us promptly at the contact address below if you suspect unauthorised access.

4. Acceptable use

You may link only a WhatsApp account that you own, or for which you have the account holder's clear, informed permission. You must not:

  • use the Service to monitor, track or collect messages of another person without their knowledge and consent, or in breach of any law on interception, privacy or data protection;
  • use the Service for unlawful, harassing, fraudulent or abusive purposes;
  • attempt to break, probe, overload or bypass the security or rate limits of the Service, or use bots to register accounts;
  • resell, sublicense or provide the Service to third parties, or use it to build a competing service;
  • upload or process material you have no right to process.

5. Your data and other people's messages

You keep all rights in the messages and other content in your archive (“Your Content”). You give us a limited licence to host, process and display Your Content solely to provide the Service to you.

Your archive will contain messages written by other people (your contacts and group members). You are responsible for having a lawful basis to keep and use that data, and for how you use or share exports. Where privacy law applies, you act as the controller of that content and we act as your processor (see the Privacy Policy).

6. How the Service works

  • The Service is read-only. We do not send messages, mark messages as read, or change anything in your WhatsApp account.
  • How much history is synchronised is decided by WhatsApp when you link a device. We do not promise a complete history, real-time delivery, or that every message will be captured.
  • We store message text, captions and metadata (type, time, sender, edited/deleted status) and, within your storage allowance, the media files in your chats: photos, videos, voice notes, documents and stickers. Storage is one pool shared by all your numbers: each active number adds 100 MB, and you can buy extra storage in 1 GB steps. Once the pool is full new media is no longer saved (text keeps syncing) until you free space or add storage. Files WhatsApp has already removed from its servers cannot be retrieved. Media is encrypted at rest.
  • We may change, suspend or discontinue features, and we aim for high availability but do not guarantee uninterrupted service.

7. Plans, subscriptions and payment

  • Free month: your first number is free for one month (one free month per user, no card needed). When it ends, syncing for that number stops unless you subscribe. Your archive remains available to view, export and delete.
  • Paid numbers: every WhatsApp number is a paid subscription, billed monthly or, where offered, yearly, in advance, currently HK$49 per number per month. Prices are shown before you pay and exclude taxes unless stated.
  • Extra storage: you may add storage in 1 GB steps as a separate monthly subscription (with its own renewal date). Changing the amount is prorated by Stripe; cancelling stops future charges and the storage stays until the end of the paid period. When storage ends and your files exceed your allowance, we keep existing files (they are only deleted by your retention settings or by you) but do not save new media until you are back under the allowance.
  • Payments are processed by Stripe. We never see or store your full card number.
  • Renewal: subscriptions renew automatically each billing period until cancelled. You can cancel at any time from the Billing page (Stripe customer portal). Cancellation takes effect at the end of the period you have paid for; you keep access until then.
  • Adding a number starts a new subscription; cancelling one number does not affect the others. Cancelling stops future charges and the number keeps working until the end of the period you paid for.
  • Failed payments: we or Stripe may retry the charge. If it cannot be collected, the paid accounts may be paused.
  • Price changes: we will give at least 30 days' notice before a price increase applies to your next renewal.
  • Each extra number is a separate subscription with its own renewal and expiry date. When a number's paid or free period ends, syncing for that number stops; its archive remains available to view, export and delete, and syncing resumes if you renew.
  • Free time: we may add free time to a number (for example referral rewards, promo codes or goodwill). If the number has a live subscription we move its next billing date back by the same time, so you are not charged during it. Free time has no cash value.
  • Promo codes: codes may give free months or a discount for a stated period, may be limited in number, time or to new numbers or renewals, can be used once per account, and cannot be combined or exchanged for cash. We may withdraw a code or refuse abuse.
  • Referral programme: you get a personal referral code. When the number of friends we set (currently 3) sign up with your code and link their own WhatsApp number, your account earns free time (currently 1 month on one number); this repeats. Self-referrals, duplicate numbers, fake or automated sign-ups and other abuse do not count, and we may review, withhold or reverse rewards. We may change or end the programme at any time.
  • Refunds: except where the law requires otherwise, fees are non-refundable for a period already started. If you believe you were charged in error, contact us within 14 days and we will review it. Nothing here limits any statutory consumer rights you may have.

8. Retention and deletion

You can delete the archive of any linked account, or your whole account, at any time from the dashboard. Deletion removes your data from our live systems immediately. Encrypted backups are overwritten on a rolling basis and expire within 35 days. Details are in the Privacy Policy.

9. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with notice where reasonable, if you breach these Terms, create risk or legal exposure for us or others, abuse the Service, or fail to pay. We may close the Service entirely on reasonable notice, and in that case will give you time to export your data.

10. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, completeness and non-infringement. The Service depends on a third-party platform we do not control, and may stop working at any time.

The archive is a convenience copy, not a guaranteed record. Do not rely on it as your only copy of important or legally required information.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill, or WhatsApp account access.

Our total liability for any claim relating to the Service is limited to the greater of (a) the fees you paid us in the 12 months before the claim arose and (b) US$50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including for fraud or for death or personal injury caused by negligence.

12. Your responsibility to us

You agree to indemnify us against claims, losses and costs arising from your breach of these Terms or your unlawful use of the Service, including any claim by a person whose messages you collected without a lawful basis, to the extent permitted by law.

13. Changes to these Terms

We may update these Terms. For material changes we will email you or show a notice in the Service at least 14 days before they take effect. If you keep using the Service after the effective date, you accept the new Terms. If you disagree, delete your account before then.

14. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have non-exclusive jurisdiction, without affecting any mandatory consumer rights you have in your country of residence.
